Consumer Protection Act, 2019

News: Consumer Protection Act, 2019 comes into force from today.

About Consumer Protection Act, 2019

CP Act, 2019 replaces Consumer Protection Act 1986 and extends to the whole of India except the State of Jammu and Kashmir.

Objective: Protection of the interests of consumers by establishment of authorities for timely and effective administration and settlement of consumers’ disputes. 

Act not only applies to provide protection to buyers from traditional sellers but also from the new e-commerce retailers/platforms. 

Advisory councils 

Central Consumer Protection Council/Central councils shall be set up at central level as an advisory council, headed by the Union Minister of Consumer Affairs, Food and Public Distribution with the Minister of State as Vice Chairperson and 34 other members from different fields. 

At least one meeting of the Council shall be held every year. Councils will advise on promotion and protection of the consumers’ rights under this Act.

State Consumer Protection Council will be setup in every state on the same line with not more than 10 official or non-official members.  Councils will advise on promotion and protection of the consumers’ rights under this Act on the state level.

District Consumer Protection Council will be set up in every District by concerned states under the chairmanship of district collector. Councils will advise on promotion and protection of the consumers’ rights under this Act on the district level.  

Consumer Protection Authority

Central Consumer Protection Authority or Central Authority shall be established consisting of a Chief Commissioner and members as prescribed by central government to promote, protect and enforce the rights of consumers.

The CCPA will be empowered to 

  • conduct investigations into violations of consumer rights and institute complaints / prosecution, 
  • order recall of unsafe goods and services, 
  • order discontinuance of unfair trade practices and misleading advertisements, 
  • impose penalties on manufacturers/endorsers/publishers of misleading advertisements.

Consumer Disputes Redressal Commission: 

District Consumer Disputes Redressal Commission or District Commission, to be set up by state governments in every district. More than one District Commission can be established in a district.

Conditions related to appointment, term of office, resignation and removal of the President and members of the District Commission will be framed by central government, whereas rules regarding r salaries and

allowances and other terms and conditions of service will be framed by state governments.  

Any person aggrieved by an order made by the District Commission may prefer an appeal against such order to the State Commission on the grounds of facts or law within a period of forty-five days from the date of the order. 

Any person aggrieved by an order made by the State Commission may prefer an appeal against such order to the National Commission within a period of thirty days from the date of the order.

Consumer Mediation Cell: 

Alternate Dispute Resolution mechanism of Mediation has been provided. A complaint will be referred by a Consumer Commissions for mediation, wherever scope for early settlement exists and parties agree for it. 

Mediation will be held in the Mediation Cells to be established under the aegis of the Consumer Commissions.  There will be no appeal against settlement through mediation.

Central Government shall establish, by notification, a consumer mediation cell to be attached to the National Commission.

State Government shall establish, by notification, a consumer mediation cell to be attached to each of the District Commissions and the State Commissions.

E-commerce: Rules for prevention of unfair trade practice by e-commerce platforms will also be covered under this Act. 

E-commerce entity is required to provide information related to every aspect like charge-back options, return, exchange, grievance redressal mechanism, every imp. payment related aspect including country of origin. 

e-commerce platforms have to acknowledge the receipt of any consumer complaint within forty-eight hours and redress the complaint within one month from the date of receipt. 

Product Liability Action: It brings within its scope, the product manufacturer, product service provider and product seller, for any claim for compensation. 

Punishment: The errant businesses will be penalized with up to 6 months in jail or a fine of up to Rs 1 lakh if the consumers do not suffer any injuries. 

In cases where the consumer is injured, the fine to the manufacturer, seller or distributor could go up to Rs 5 lakh and up to seven years in jail. 

In case of death of the consumer, the culprit will have to pay a minimum fine of Rs 10 lakh and spend seven years in jail, which can be extended to life imprisonment.

New Delhi’s “e-ICU” Video Consultation Program

News: AIIMS New Delhi has started a video-consultation program with ICU doctors across the country called e-ICU.

Program details 

Objective: To reduce mortality from COVID-19 by learning from shared experience and strengthening best practices among hospitals with 1000 beds including isolation beds, oxygen supported and ICU beds. 

Coverage: 43 Big Hospitals in 11 States across the country have collaborated with AIIMS So far. 

The maximum of total 13 hospitals from the state of Tamil Nadu benefited from the initiative so far followed by 10 hospitals from Mumbai, 5 hospitals from Assam and so on.

4 such sessions have been covered so far with each session span over 1.5 to 2 hours. 

Areas of discussion in these sessions include: 

  • Need for rational use of ‘Investigational Therapies’ like Remdesevir, convalescent plasma and Tocilizumab. 
  • Efficacy and practicality of Plasma treatment
  • Use of proning, high flow oxygen, non-invasive ventilation
  • Need for repeat testing, admission and discharge criteria, management of post discharge symptoms, and return to work

Initiatives for Atmanirbhar Bharat Abhiyan

‘Manodarpan’ initiative

News: Union Human Resource Development Ministry is going to launch ‘Manodarpan’, an initiative under Atmanirbhar Bharat Abhiyan.

About Initiative 

Objective: To provide psycho-social support to students, teachers and parents for their issues related to mental health and well-being.

It has been launched as a part of strengthening human capital and increasing productivity and efficient reform and initiatives for the education sector. 

Mobilizing youth towards Atmanirbhar Bharat

In another initiative, Ministry of Youth Affairs and Sports partners with YuWaah (a multi-stakeholder platform formed by the UNICEF) to strengthen resolve to mobilise 1 crore youth volunteers to achieve goals of Atmanirbhar Bharat. 

This partnership has been signed to promote volunteerism among the youth of India as well as to help them transition from education and learning to productive work, skilling and being active citizens.

‘YuWaah’ Generation Unlimited

It is a multi-stakeholder alliance which aims to facilitate youth to gain relevant skills for productive lives and the future of work.

The target age group of YuWaah includes adolescent girls and boys. 

Mission: To promote access to foundational, transferable and 21st century skills for youth inside and outside formal education systems, which includes defining foundational skills, life skills and flexible learning and identifying and scaling impactful delivery models.

YuWaah intends to create platforms to guide youth to market opportunities (career guidance, mentorship, internships, apprenticeships) and facilitate integration of career guidance in school education.

Atmanirbhar Bharat Abhiyan

“crisis has taught us the importance of local manufacturing, local market and local supply chains. All our demands during the crisis were met ‘locally’. Now, it’s time to be vocal about the local products and help these local products become global”

Towards building an Atmanirbhar Bharat, or a self-reliant, resilient India, government announced an economic stimulus package for Rs 20-lakh-crore (estimated at 10% of the GDP).

Major aim of the package is providing the much needed financial & policy support to the cottage industry and MSMEs in India.

Zoram Mega Food Park in Mizoram in inaugurated

News: Union Minister of Food Processing Smt Harsimrat Kaur Badal e-inaugurates Zoram Mega Food Park in Mizoram.

News details 

Food Park will help in doubling farmer’s income in the region and will provide gainful employment to youth. 

Benefits: 

  • The Food Park built at a cost of Rs 75 crore and spread over 55 Acres of land. 
  • It will provide employment opportunities to over 5,000 people in the region and will directly benefit over 25,000 farmers. 
  • By removal of middlemen, it will help in doubling the income of farmers in the area. 
  • It will help to reduce nearly 40% wastage of fruits in the absence of any processing unit. 
  • Like Sikkim (Declared as an organic state), it will help North-East region in becoming Organic Destination of the world due to its rich agricultural and horticultural produce. 
  • Location of Zoram Mega Food Park near National Highway 54, will be an added advantage in terms of transportation.  

Mega Food Park Scheme

Launched by: Ministry of Food Processing Industries in 2008-09. 

Aim: providing a mechanism to link agricultural production to the market by bringing together farmers, processors and retailers.to 

  • Create employment opportunities particularly in rural sector
  • minimizing wastage
  • ensure maximizing value addition, 
  • Increase farmers income 

MFP are based on “Cluster” approach and envisages creation of state of art support infrastructure in a well-defined agri / horticultural zone for setting up of modern food processing units in the industrial plots provided in the park with well-established supply chain.

The Mega Food Park project is implemented by a Special Purpose Vehicle (SPV) which is a Body Corporate registered under the Companies Act.

Project components

Infrastructure of Mega Food Park includes Collection Centres (CCs), Primary Processing Centers (PPCs), Central Processing Center (CPC) and Cold Chain infrastructure.

Collection Centers and Primary Processing Centers (PPCs): These centres provide facilities for cleaning, grading, sorting and packing, dry warehouses, specialized cold stores including pre-cooling chambers, ripening chambers, reefer vans, mobile pre-coolers, mobile collection vans etc.

Central Processing Centers (CPC): These centres provide common facilities like Testing Laboratory, Cleaning, Grading, Sorting and Packing Facilities, Dry Warehouses, specialized storage facilities. The extent of land required for establishing the CPC is around 50- 100 acres.

Presently, 18 Mega Food Park Projects are under implementation in various states and 19 Mega Food Parks have already become functional in the States. 6 of them are in the North-eastern region.

Electric Vehicle charging infrastructure and indoor air quality

News: India’s first of its kind public EV Charging Plaza inaugurated and RAISE program launched by Union Power Minister.

News details 

India’s first public EV (Electric Vehicle) charging plaza inaugurated by Union Power Minister at Chelmsford Club in New Delhi.

Aim: Enhancing energy efficiency and promoting e-mobility.

Established by: Energy Efficiency Services Limited (EESL) in collaboration with NDMC.

Energy Efficiency Services Limited (EESL)

  • EESL is promoted by Ministry of Power, Government of India as a Joint Venture of four reputed public- sector undertakings i.e. NTPC Limited, Power Finance Corporation Limited, REC Limited and POWERGRID Corporation of India Limited.
  • Objective: To carry out and promote the business of Energy Efficiency and climate change including manufacture and supply of energy efficiency services and products
  • EESL is implementing the world’s largest energy efficiency portfolio across sectors like lighting, buildings, electric mobility, smart metering, agriculture, etc.

This plaza will host 5 Electric Vehicle Chargers of different specifications. 

FAME-II scheme 

Faster Adoption and Manufacturing of Hybrid and EV (FAME) scheme was launched in 2015 to provide subsidies for electric 2- and 3-wheelers, hybrid and e-cars and buses. 

Phase – II of scheme titled ‘Faster Adoption and Manufacturing of Electric Vehicles in India (FAME India)’ has been launched for the period 2019-20 to 2021-2022 with an outlay of Rs 10,000-crore.

Coverage: Buses with EV technology; electric, plug-in hybrid and strong hybrid four wheelers; electric three-wheelers including e-rickshaws and electric two-wheelers will be incentivised under this scheme.

Rs 1,000 crores has been set aside for setting up charging stations for electric vehicles.  

Major objectives of scheme are: 

  • Demand creation for EV’s by offering incentives 
  • Creating EV charging infrastructure 
  • Focussed on public Transport
  • ​Establishment of charging stations in major highways

Private electric vehicles are not covered under this scheme.  

 

Retrofit of Air-conditioning to improve Indoor Air Quality for Safety and Efficiency” (RAISE) national programme 

Launched by: Union Power ministry 

It is a joint initiative of EESL and USAID’s MAITREE programme, aimed at improving indoor air quality for Safety and Efficiency. 

Need: Poor air quality has been a concern in India for quite some time and has become more important in light of the COVID pandemic. As people return to their offices and public spaces, maintaining good indoor air quality is essential for occupant comfort, well-being, productivity and the overall public health. RAISE program is aimed at improving this situation. 

EESL’s corporate office in Scope Complex has been taken up as a pilot for this initiative. The pilot focuses on improving indoor air quality (IAQ), thermal comfort, and energy efficiency (EE) in EESL office’s air conditioning system.

As per EESL, project shown about 80% improvement in Air Quality parameters with almost no implementation hassles.

USAID’s MAITREE program 

The Market Integration and Transformation Program for Energy Efficiency (MAITREE) is a part of the US-India bilateral Partnership between the Ministry of Power and USAID. 

Aim: accelerating the adoption of cost-effective energy efficiency as a standard practice within buildings, and specifically focuses on cooling.

USAID: USAID is the world’s premier international development agency and a catalytic actor driving development results. USAID works to help lift lives, build communities, and advance democracy.

United States Agency for International Development (USAID) is an independent agency of the United States, responsible primarily for administering civilian foreign aid and development assistance.
